Dear Incline Village & Crystal Bay Property Tax Protesters,
 
District Attorney Richard Gammick is now pointing an accusatory finger at the state of Nevada for causing the property tax fiasco now being experienced in Washoe County. 
 
Instead of taking responsibility for the enormous amount of over assessed taxes levied on the residents of Incline Village and Crystal Bay and collected by the County, he suggests that taxpayers should have filed lawsuits against the state.
 
Even though the Nevada Supreme Court ruled that the taxes collected were unconstitutional, illegal, null and void, and last October Judge Adam’s ordered that the 2006 assessments of all IV/CB residential properties be rolled back to their 2002 values and refunds paid to the property owners, the District Attorney’s office is using every available legal maneuver to avoid complying with the decisions of the court.
 
GAMMICK’S GAMES
 
District Attorney Gammick is arguing that in order to be eligible to receive returns of their over collected tax dollars, the 9000 property owners who are owed tax refunds must have personally appeared before the State Board of Equalization (SBOE) to appeal their taxes (even if they were members of the armed forces serving in Afghanistan or Iraq); filed Paid Under Protest forms with every tax payment (even though their cases had previously been won before the County Board of Equalization); and have submitted individual appeal petitions to the County and State Boards of Equalization.
 
In addition, the District Attorney is attempting to claim that the mass mailing to all 9000 taxpayers of an almost eligible copy of the Complaint that he filed in court against the SBOE’s decision in our favor is legal notice that all of us are also parties to that lawsuit, and should be forced to individually defend ourselves.
 
In light of actions taken by Mr. Gammick, his recent statements to the media that “…there is really strong argument that Incline residents and Washoe County are not so much adversaries as allies” is truly amazing. He also said that “…there is a perception that the county and the residents are on different sides of the issue, but this could not be further from the truth.” The TRUTHis badly served as he also denies any knowledge of settlement proposals made by the Village League in 2002, even though the offers were made by Attorney Norman Azevedo, representing residents of Incline Village, directly to Terrence Shea, the Deputy District Attorney then representing Washoe County.
