Dear Incline Village & Crystal Bay Property Owners,

We journeyed into Tuesday’s Washoe Board of Commissioner’s meeting and asked them to do three simple things:

1. Read the Court’s decision

2. Get a second opinion

3. Consult the County Assessor

These are not monumental tasks – just basic common sense. Anyone interested in the impact of this case would want to read the decision, which explains conclusively why and how Washoe County and the State of Nevada violated the constitutional rights of Incline area taxpayers. The District Court devoted a 57 page decision to drive home the point that a government must refund with interest taxes collected in violation of constitutional rights.

If a court orders you to pay, it would be a good idea to read the decision to learn about why you lost, so that you can make an informed choice about whether to fight or pay. In this case there are 57 pages of reasons why the county and state must pay. If that’s not enough, then at least get a second opinion about it before launching another misguided spending spree. The County Commission should consult an independent lawyer with no stake in this, and talk to the County’s own expert – the County Assessor.

Fighting a court order can be very costly. In this case after 16 years the county has lost 3 times in the Supreme Court. With that kind of track record how could a fourth attempt costing the county AN ADDITIONAL $5 million dollars be justified? Perhaps they will listen to you, their constituents.

We would urge you to contact the commissioners and demand that they end this matter as the Court has ordered. Work out the details for returning to taxpayers their own money that should have never been taken in the first place.
