<p><font size="-1" face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular"><b>Dear Fellow Incline Village & Crystal Bay Property Owners,</b></font></p>
<p><font size="-1" face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular">We had a terrific win on February 17, 2005 before the Washoe County Board of Equalization (CBOE), when they voted to reverse the 8% increase that had been assessed against all of our land values. Now, the Washoe County <b>Commissioners</b> seems to be making an attempt at an end-run to </font><font color="red" face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular"><b>reinstate</b></font><font size="-1" face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular"> the 8% tax increase (<a href="Alert65.html">Click here</a> for the previous alert). </font></p>
<p><font size="-1" face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular">A Summons was delivered to Gary Schmidt, a member of the County Board of Equalization, from Bonnie Weber, Chair of the Washoe County Commission on February 15, 2005,</font><font color="red" face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular"><b> THE NIGHT BEFORE OUR MASS APPEAL HEARING</b></font><font size="-1" face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular">. It challenged his performance as a member of the CBOE and noticed him that, “His character, alleged misconduct, professional competence or physical or mental health”, would be considered at the March 8th Commission hearing. </font></p>
<p><font size="-1" face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular">It seems apparent that the timing of this act was a blatant attempt to intimidate Mr. Schmidt into resigning from the Board, before our hearing started the next day; or to vote against us, in an effort to avoid being publicly humiliated. Gary Schmidt, without saying a word to anyone, stayed the course and we won our Appeal. </font></p>
<p><font size="-1" face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular">The Village League feels that if the Commissioners are successful in removing Mr. Schmidt from the CBOE with these trumped up charges, they will then replace him with an alternate member whose vote they would control. </font></p>
<p><font color="red" face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular"><b>The 8% tax increase against our properties could then be reinstated.</b></font></p>
<p>.</p>
<p><font size="+1" face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular"><b>Background on Gary Schmidt:</b></font><font size="-1" face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular"> Gary spent more time than any other member </font><font size="-1" face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular">of the CBOE in attending Nevada Tax Commission and Tax Department meetings, reading the materials on which votes would be taken and in understanding the <b>TOTAL</b> property tax issue. He is a fellow property owner who has been challenging tax issues for 20 years. He votes to do the </font><font size="+1" color="#006400" face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular"><b>“right thing”,</b></font><font size="-1" face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular"> and is not in the </font><font size="-1" face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular">pocket of the Assessor. </font></p>
<p><font size="-1" face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular">When he was nominated and </font><font face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular"><b>unanimously</b></font><font size="-1" face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular"> elected by the County Commissioners to serve a four year term as a member of the </font><font size="-1" face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular">CBOE, he was a familiar figure to them. </font></p>
<p><font size="-1" face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular">Last year, they found no problem with his service as a member of the Board – only now, when the Assessor feels threatened, do they “challenge his performance”. </font></p>
<p><font size="-1" face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular">Of course, this action on the part of the Commissioners will send a chilling message to anyone who might have ever considered serving on the Washoe County Board of Equalization.</font></p>
