<p><font size="-1" face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular"><b>Dear Fellow Taxpayers,</b></font></p>
<p><font size="-1" face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular">This Alert, unfortunately, is bitter-sweet. As many of you are aware the Washoe County Assessor, Robert McGowan, appealed our success, in overturning the 8% Taxable Land Value increase at the County Board of Equalization, to the State Board of Equalization. The hearing was held on August 15, 2005.</font></p>
<p><font size="-1" face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular">The good news is that the County Board’s ruling that the Assessor failed to use the proper rules in assessing our properties was not appealed, which helps us in our other court actions, (<i>if we can ever get a judge to RULE</i>). </font></p>
<p><font size="-1" face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular">The bad news is that the State Board reinstated the 8% Land Value increase, after our hard earned victory for 1200 appellants.</font></p>
<p><font size="-1" face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular">We are meeting with our attorney and Senator Randolph Townsend next Tuesday, and in light of the facts, may be filing for a re-hearing by the State Board. </font></p>
<p><font face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular"><b>What Happened?<br>
</b></font><font size="-1" face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular">Once every 5 years our area is reappraised. In the intervening years, a <b>“factor”</b> is applied to the land and the improvements. The amount of the land factor is first determined by the Washoe County Assessor, who then presents it to the Department of Taxation for verification. After the Department determines its “accuracy”, they ask for approval from the Nevada Tax Commission in October. If approval is granted, the land factor is then combined with an improvement factor, and together determine the increase to the Taxable Value of your property.</font></p>
<p><font size="-1" face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular">As the Washoe County Assessor had not complied with the new regulations, which the Department of Taxation failed to tell the Tax Commission, our land factor of 8% was incorrect. The Assessment Notices were mailed, as usual, about the middle of December, which left filing appeals to the County Board of Equalization as our only option to rectify this error</font></p>
<p><font size="-1" face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular">Deputy District Attorneys, Terrence Shea and Peter Simeoni, who represent the Assessor and the County Board of Equalization, respectively, and Deputy Attorney General Dawn Kemp, who represents the State Board of Equalization, all took the position that the County Board had no authority to overturn a factor approved by the Nevada Tax Commission. </font><font size="-1" color="red" face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular"><b>THERE IS NO SUCH LAW!!! </b></font></p>
<p><font size="-1" face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular">All tax appeals <b>must</b> begin at the County Board. If these attorneys were correct, the County Board of Equalization could never change an appraised value. The statutes require that the land factors <b>must </b>be approved <b>every year</b> by the Tax Commission; therefore, any time the County Board changed a valuation, either up or down, they would be overturning a factor approved by the Tax Commission. If an appeal cannot be heard by the County Board of Equalization, to whom is the taxpayer to turn? It is a “Catch 22”.</font></p>
<p><font size="-1" face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular">Some of us may be receiving an increase in our Total Property Taxes up to a maximum of 3%, and others 6.9% over last years taxes. At least both are lower than the 8% increase that Washoe County Assessor Robert McGowan wanted. Thank heavens that we were able to help in getting the Tax Cap passed by the last Legislature.</font></p>

<p><font size="-1" face="Arial,Helvetica,Geneva,Swiss,SunSans-Regular">We are all furious at this incredibly unfair and unjust outcome, which was orchestrated primarily by State Board Member Steven Johnson, a partner in Johnson-Perkins, an appraisal firm with huge Washoe County contracts, and Dawn Kemp, a Deputy Attorney General, who gave the State Board incorrect legal opinions. We will do our best to get this ruling corrected, either in a re-hearing or in court. <b><i>We really hope it will not stand.</i></b> </font></p>
