<b>To Our Friends in Incline Village and Crystal Bay,<br><br>
</b>Yesterday the Supreme Court issued an Order GRANTING our “Emergency
Motion to Stay” the hearing before the County Board of Equalization which
was originally scheduled for next Tuesday in Reno at the Reno Convention
Center. <font size=4 color="#FF0000"><b>Therefore, that hearing is
cancelled and no one has to attend anything at the moment.<br><br>
</b></font>This is HUGE news as a Motion such as ours is only granted by
the Supreme Court if the court feels that, “…petitioners are likely
to prevail on the merits of the writ petition”.<br><br>
In our Alert #132 we explained that Attorney Suellen Fulstone was filing
a Writ of Mandamus to the court on behalf of the Village
League. The State of Nevada and Washoe County must now file
answers to the Supreme Court, within thirty days, stating why they feel
that the court should not issue the Writ to us.<br><br>

MEAN?<br><br>

If the Supreme Court rules in our favor, after receiving answers
from the State and County, the State Board of Equalization will be
ordered to dismiss the Washoe County Assessor’s appeal of our victory
last year before the County Board of Equalization and will require Washoe
County to comply with the Supreme Court’s decision issued last December
28, 2006. That ruling affirmed a roll-back of all of the
Incline Village and Crystal Bay residential property taxes to their 2002
assessed values as ordered by Carson City District Court Judge
Maddox.<br><br>
If the Washoe County Treasurer, Bill Berrum, then continues to withhold
our refunds, he could be personally found to be in “contempt of court.”

IS CANCELLED!<br><br>

Please tell any of your friends that may have been planning to attend
that the hearing will not take place. We received the Supreme Court
Order just one hour after we had mailed our notice requesting your
presence.<br><br>
Our sincere thanks to all of you who already had indicated that you would
be there for us. With the receipt of this incredibly good news your
attendance will not be necessary!! <br><br>
There is a lot going on behind the scenes. We are still fighting
every step of the way and with your help we will continue to do
so.<br><br>
