    SUBJECT:           Update on our Tax Revolt Activity

     

    Dear Fellow Incline Village & Crystal Bay Property Owners,

     

    The Washoe County Board of Equalization Hearings are over and the deadline to file an appeal at the Nevada State Board of Equalization has passed.  You should also have paid under protest your last and final property tax payment for the year 2003-2004.  So, you may ask, what is next with respect to our property tax revolt?  Will anything happen between now and December 15th, when we receive our next property tax assessment?

     

    First, let me assure you that our Tax Revolt Committee is extremely busy behind the scenes. Only about 10% of you received any kind of tax relief at the Washoe County Board of Equalization, which is about what we expected, BUT we did send a very strong message to both the County and the State of Nevada that Tahoe Taxpayers are not going to take it any more!  Over 1,300 appeals were filed, which consumed a very large amount of time by the County Board of Equalization and their staff.

     

    Lawsuits: We have filed 4 lawsuits.  They are now working their way through the Nevada court systems.  Each lawsuit will take anywhere from 6 weeks to a year to be heard and ruled upon.  In summary the 4 lawsuits are: Judicial Appeal (Norman Azevedo, Esq.), Appeal to the Nevada Supreme Court (Suellen Fulstone, Esq.), Class-Action Lawsuit (Suellen Fulstone, Esq.) and Lawsuit for Due Process (Suellen Fulstone, Esq.)

     

    The Board of Equalization: Many of you have filed an appeal with the Nevada State Board of Equalization.  Some of the appeals have already been scheduled to begin March 22 and the remainder will most likely be scheduled in the next couple of weeks.  The outcome of these hearings will be interesting to watch.

     

    Washoe County Commissioners:  We have been told that the Chairman of this year's County Board of Equalization, Ron Fox, has resigned. We are meeting with our local County Commissioner to help us in our efforts to stop these outrageous property tax increases. 

     

    Nevada State Tax Commission:  We have attended numerous "workshops"' with the Department of Taxation and met with key members of the State Tax Commission and feel that we are very close to achieving significant changes to the Rules and Regulations which the assessors must follow in appraising our properties.  We have a high level of confidence that the State Tax Commission understands our property tax revolt, and we believe will implement changes that will help equalize property taxes for all Nevada Property Tax Owners.

     

    Nevada State Legislature:  To report on the number of phone calls and meetings we are having with key members of our legislature would fill many email messages.  As you know, the Nevada Legislature will not meet until next year. We have one year to set the stage for the 2005 Nevada Legislature.  Again, lots of effort is being expended to ensure that the taxes for all Nevada Property Tax Owners will be uniform and equal.

     

    Nevada Taxpayers Association:  We are continuing to work with several state private citizens groups to level the playing field for all Nevada Taxpayers.  The how, what, when and where is yet to be determined..we all know the WHY.  

     

    Bottom Line:  A huge amount of effort is being expended by the volunteers of the tax revolt committee on your behalf.  We wish we could give you a blow by blow report on each phone call, each meeting, each email, etc.  All of them are important and the volume is staggering.

     

    Responses to Your Questions:  We have responded to hundreds of phone calls and email messages, and we will continue to do so, in an effort to help every property owner with answers to questions and with help in understanding the unfair and punishing appraisal methods used in Incline Village/Crystal Bay by the Washoe County Assessor.   We will continue to keep you informed via email "Alerts" as new developments come about.

     

    Property Owners Support:  Our Organization has grown considerably over the past year; we now have nearly 2,500 property owners in our data base. When you consider that a large majority have wives and children, many who vote in Nevada, we can have a powerful impact on our local and state governments and when the time comes, to go to court.  Your continued moral and financial support is extremely important and very much appreciated.  Stay with us we still have quite a way to go.  

     

    Reporting on our efforts: In the interim, becasue nearly 3,000 property owners live away from IV/CB, the best way to report to you is by forwarding, via e-mail, copies of all local newspaper's articles.  We suggest you periodically surf to our website, www.NevadaPropertyTaxRevolt.org and click on the News Articles page and read the most recent newspaper article published.  

     

    News:  As key news stories break in the future, we will let you know via our tax revolt email message Alert system.  Reno TV Channel 4 is planning to do a series on our efforts and what is the REAL story behind the unfair methods of taxation that are being used by the Washoe County Assessor.

     

    Volunteers: Please note that our tax revolt committee and all of their efforts are strictly voluntary.  We are fighting for a cause, and that is for fair and equitable taxation for all Nevada Taxpayers.

     

    In Summary: Just remember, it takes patience and tenacity to win these battles but we will win!  Thank you for your past financial support. In case there is anything left in your checking account after paying this year's property tax, sit down and write a check to the Village League, our legal bills continue to grow and we could sure use your help.
