Dear Incline Village & Crystal Bay Property Owners,
 
Two powerful court decisions in our
favor were entered last Friday. We had requested a Status Conference before
Judge Brent Adams due to the excruciatingly slow payment of refunds by the
County, with no end in sight.  The tax
refund payments are now on a fixed schedule.  The judge set a deadline of August 23, 2013, for the County Treasurer to
complete the repayment process.  Six
percent interest will continue to accrue on refunds until paid and sanctions
will be levied by the Court against the Treasurer should any refund be left
unpaid after that date. 
 
 
NEVADA SUPREME COURT RULES
 
 
The Nevada Supreme Court also issued
an Order granting our appeal of a District Court decision and directing the
District Court to send the case to the State Board of Equalization to equalize
property valuations throughout the state. This case was filed in 2003 and has
met with a great deal of resistance.  This is the second time in the case that we have had to take the issues
to the Supreme Court and that the Supreme Court has decided in favor of
taxpayers.  This case concerns, in part,
the lack of equalization between Incline Village/Crystal Bay and the lakeside
portion of Douglas County.

Our goal has always been to obtain
equal and uniform property taxation for every taxpayer and the Nevada Supreme
Court agrees. We applaud this courageous decision by the Supreme Court
Justices.
 
Results from implementing this Order
will not be quickly obtained but we are not deterred. We will keep all of you
informed as the process continues.
